Summary: By downloading, installing, or playing games provided by SMISH Ventures (such as Movie Mogul and Founder Sim), you agree to these Terms. Please read them carefully. All in-app purchases are managed through the Apple App Store, and virtual goods have no real-world monetary value.
1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of mobile applications, digital content, software, and services provided by SMISH Ventures ("Company", "we", "us", or "our").
By installing, copying, or otherwise using our games, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not install or use our applications.
2. Limited License to Use
Subject to your compliance with these Terms, SMISH Ventures grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and run the application solely on compatible personal Apple devices (iPhone, iPad, or Mac as supported) that you own or control, for your personal, non-commercial entertainment purposes.
You agree not to:
- Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code or underlying simulation algorithms of the games;
- Modify, translate, adapt, alter, or create derivative works of any game content, artwork, sound, or code;
- Use automated scripts, bots, hacks, or cheats to manipulate game state, in-game economics, or achievements;
- Rent, lease, lend, sell, sublicense, distribute, or otherwise commercially exploit the software.
3. Apple App Store Specific Terms
If you downloaded the application from the Apple App Store, the following terms apply:
- Parties: These Terms are concluded solely between you and SMISH Ventures, not with Apple Inc. SMISH Ventures is solely responsible for the application and its content.
- Maintenance & Support: SMISH Ventures is solely responsible for providing any maintenance and support services with respect to the app. Apple has no obligation whatsoever to furnish any maintenance and support services.
- Warranty: In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever.
- Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
4. In-App Purchases & Virtual Currency
Our games may offer opportunities to acquire virtual goods, virtual currencies (e.g., in-game Studio Cash, Era Passes, Boosters), or unlock premium feature tiers through in-app purchases (IAP).
- No Real-World Value: Virtual items and currencies represent a limited, non-transferable, revocable license and do not constitute real-world property or financial assets. They cannot be exchanged, transferred, or redeemed for fiat currency or any monetary equivalent.
- Billing: All billing and payments are handled exclusively by Apple through your Apple ID account. All inquiries regarding billing discrepancies or refund requests must be directed to Apple Support at reportaproblem.apple.com.
- Finality of Sales: Except as required by applicable consumer law or Apple's platform refund policies, all purchases of virtual currency and items are final and non-refundable.
5. Intellectual Property Rights
All intellectual property rights in and to our games—including titles, graphics, animations, user interface designs, audio, musical compositions, scripts, simulation algorithms, logos, and trademarks—are the exclusive property of SMISH Ventures or its licensors. All rights not expressly granted to you are reserved by SMISH Ventures.
6. Termination
We reserve the right, without liability, to suspend or terminate your license to use the application if you violate any provision of these Terms or engage in fraudulent, abusive, or illegal conduct. Upon termination, your right to use the application will immediately cease, and you must delete all copies from your devices.
7. Disclaimer of Warranties
THE APPLICATION AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF THE GAME WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMISH VENTURES, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. Any legal proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.
